Terms of use

These terms are an agreement between you and Benlottejnr Apps of 9 Baliol Chambers, Hollow Lane, Hitchin SG4 9SB, United Kingdom, the publisher of DagWorld. They cover the DagWorld app, this website, and everything you read, hear or save inside them. In these terms, "we", "us" and "our" mean Benlottejnr Apps, and "you" means the person using DagWorld.

1. Accepting these terms

By downloading, opening or using DagWorld, you agree to these terms. If you do not agree, do not use the app.

Our privacy policy explains what data we collect and why. It forms part of this agreement.

We may update these terms as the app changes. When we do, we will change the date at the top of this page, and we will tell you in the app if the change is significant. Continuing to use DagWorld after a change means you accept the updated terms.

2. Who may use DagWorld

You may use DagWorld if you are old enough to enter into a binding agreement where you live, and at least 13. If you are under 13, or under whatever higher age your own country sets for agreeing to online services, you may only use DagWorld with the involvement of a parent or guardian, who accepts these terms on your behalf.

You must not use DagWorld if we have previously removed your access, or if the law where you live prevents you from doing so.

3. Your account

DagWorld requires an account. There is no guest mode: the catalogue, the search, the quotes and the players all sit behind sign-in, because each of them saves something against you.

Creating an account is free and takes no payment details.

Sign-in is through Google, through Apple, or with an email address and a password. Where you use Google or Apple, keeping that account secure is what keeps your DagWorld account secure. Where you set a password with us, choose one you do not use elsewhere and keep it to yourself. Tell us at support@dagworld.org if you believe someone else has used your account.

You are responsible for what happens under your account. Do not share it, and do not let anyone else use it as if it were theirs. This does not cut across the sharing the stores themselves provide: where you got DagWorld from the App Store, other accounts associated with yours through Family Sharing, volume purchasing or Legacy Contacts may access and use the app as Apple's own rules allow, and Google Play's family library works the same way on Android.

4. The licence we give you

We give you a personal, non-exclusive, non-transferable, revocable licence to use DagWorld and to read, listen to and watch the books, quotes, music, video and audio messages in it, for your own personal, non-commercial use.

That is the whole of what you are given. Nothing in these terms sells or assigns anything to you. You may not:

  • copy, republish, re-upload or redistribute any book, song, recording, video, cover, artwork or quote from DagWorld;
  • sell, rent, sub-licence or otherwise charge anyone for access to the content, or to your account;
  • strip, alter or work around any download protection, watermark or attribution;
  • use automated tools to scrape, harvest or bulk-download the catalogue;
  • use the content to train a machine learning or artificial intelligence model;
  • reverse engineer, decompile or tamper with the app or our servers, or attempt to reach parts of them you have not been given access to.

Books, songs, audio messages and podcast episodes you download for offline use are stored on your device so that you can use them without a connection. They remain licensed to you under this section, not sold to you, and they may become unavailable if your licence ends, your subscription ends, or the title is withdrawn.

5. Who owns the content

The books, quotes, music, video and audio messages in DagWorld are the copyright of Dag Heward-Mills. They are not ours to give away and they do not become yours by being on your device.

The DagWorld name, logo, app design, artwork and software are ours. Reading a book in DagWorld gives you no rights in any of it.

6. Quote cards and sharing

DagWorld lets you turn a quote into a share card. Those cards are for personal sharing, with friends, in a group, on your own social accounts, and they carry attribution to Dag Heward-Mills. Please leave that attribution in place.

Share cards may not be used commercially, sold, put on merchandise, or presented as your own words or as anyone else's. Sharing a card does not give you a licence to reproduce the quote anywhere else, or to build a competing collection from it.

7. Quotes you keep

You can keep quotes from his work in your own account, and they stay private: nothing you save is reviewed, seen by others, or published, and there is no route by which a quote you keep reaches the public catalogue.

Because nothing you keep is checked, you are responsible for it: do not store anything unlawful, or anyone else's original writing passed off as a quotation.

A quote you keep is stored so that it can be shown back to you on your own devices, and for nothing else. You keep whatever rights you have in it, and storing it gives us no ownership of the underlying words, which remain the copyright of their author.

8. Removal

Quotes kept in your account are not reviewed. The catalogue itself is ours to correct, and we may edit a catalogue quote for accuracy or formatting, or remove one. We do not have to give a reason, though we will usually give one.

We may also remove content, suspend a feature or restrict an account where we reasonably believe these terms have been broken, where the law requires it, or where the rights holder asks us to.

If something is removed and you think that was a mistake, write to support@dagworld.org and we will look again.

9. What is free, and what you pay for

The books are free. Every title in the book catalogue is available at no charge to anyone with an account, and we do not intend to put them behind payment.

The quotes, the music, the video and the audio messages are the paid part of DagWorld, on an auto-renewing subscription called DagWorld Premium. It comes in two lengths, and each one gives you the whole catalogue for as long as it runs:

  • DagWorld Premium Monthly, £1.49, renewing every month;
  • DagWorld Premium Yearly, £14.99, renewing every year.

Those are the United Kingdom prices. Elsewhere you pay the equivalent your store sets in your own currency, and the price you will actually be charged is shown to you in the app before you buy.

New subscribers are offered seven days free, provided through the App Store or Google Play as their own introductory offer. The trial becomes a paid subscription automatically when the seven days end unless you cancel before then; cancel in time and nothing is charged. The stores allow one introductory offer per store account, so a second account on the same device does not get a second trial. The free books are unaffected either way.

Subscriptions bought in the app are sold and billed by Apple through the App Store or by Google through Google Play, under their terms, not ours. We do not see or hold your card details.

Subscriptions renew automatically until you cancel. On an iPhone or iPad you cancel in Settings under your Apple Account, or from the DagWorld listing in the App Store. On Android you cancel from Subscriptions in the Google Play Store, which you can also reach from the subscription link in DagWorld's own settings.

Cancelling a paid period stops the next renewal rather than the period you have already paid for, so you keep access until that period runs out. A free trial is different on Android: Google Play's terms end trial access as soon as you cancel, rather than at the end of the seven days. Apple lets a cancelled trial run to its end. Neither is ours to change.

Refunds are handled by Apple or Google under their refund policies, and their default is that a cancellation does not refund the period you are in. Where the law where you live requires a refund or a proportionate one, that law applies over their default. We cannot issue a refund for a purchase we did not process, but if something has gone wrong, tell us at support@dagworld.org and we will help you take it up with them.

We will provide the subscription for the whole of any period you have paid for, as it was described to you when you bought it. We may change prices, the length of the trial, or what a subscription includes, but changes apply from your next renewal, never retrospectively or part way through a period, and we will give you notice before they take effect so that you can cancel if you would rather not continue. If we ever have to change what is free, we will say so in the app before it happens.

10. The catalogue can change

What is in the catalogue can change. Titles may be added, revised, replaced or withdrawn, and a book, song, message, video or quote you have been using may stop being available. That includes titles you have downloaded for offline use. Video is played from YouTube, so a video withdrawn there stops playing here.

We also expect to add whole categories of content over time. Nothing in these terms is a promise that any particular title, feature or category will be available, or will stay available. What we do promise is the subscription itself: individual titles come and go, but we will not empty out a period you have paid for, and section 9 says so.

We try to keep DagWorld running, but we do not promise it will be uninterrupted or error free. We may suspend it for maintenance, for security, or where a supplier we rely on fails.

11. Using DagWorld properly

Use DagWorld lawfully and reasonably. Do not use it to break the law, to harass anyone, to submit abusive or misleading material, to interfere with other people's use of the service, or to place unreasonable load on our systems.

12. No warranties

DagWorld is provided as it is and as it is available. To the fullest extent the law allows, we exclude all warranties, conditions and representations that are not written into these terms, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement.

We do not warrant that the app will meet your requirements, that it will be available at any given moment, that transcriptions and text are free of error, or that defects will be corrected.

DagWorld carries devotional and teaching material. It is not professional, medical, legal or financial advice, and should not be relied on as any of those.

Some laws do not allow certain warranties to be excluded. Where that is the case, this section applies only so far as that law permits, and your statutory rights as a consumer are not affected.

13. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential loss, for loss of profit, revenue, data or goodwill, or for the cost of substitute services, arising out of your use of DagWorld.

Where we are liable, our total liability to you for all claims connected with DagWorld is limited to the greater of the amount you paid us for DagWorld in the twelve months before the claim arose, or £50.

Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.

14. Ending this agreement

You can stop using DagWorld at any time. You can delete your account and the personal data attached to it from inside the app, or by following the steps on our delete account page.

We may suspend or end your access if you seriously or repeatedly break these terms, if we are required to by law or by the rights holder, or if we discontinue the service. Where we can reasonably give you notice first, we will.

When your access ends, the licence in section 4 ends with it, including for downloaded titles. Sections about content ownership, warranties, liability and governing law survive.

15. Governing law

These terms, and any dispute arising out of them or out of your use of DagWorld, are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer, this does not remove the protection of any mandatory law of the country where you live, and it does not stop you bringing a claim in your own local courts where that law gives you the right to.

16. If you got DagWorld from the App Store

Apple requires every app sold on the App Store to say the following, and it forms part of this agreement wherever you downloaded DagWorld from Apple. Where you got DagWorld from Google Play or used it on the web, this section does not apply to you and nothing in it changes the rest of these terms.

  • This agreement is with us, not with Apple. It is concluded between you and Benlottejnr Apps only. Apple is not a party to it, and we, not Apple, are solely responsible for DagWorld and everything in it. Nothing in these terms sets usage rules that conflict with the Apple Media Services Terms and Conditions or the Volume Content Terms, which we confirm we have had the opportunity to review.
  • What the licence covers. The licence in section 4 is a non-transferable licence to use DagWorld on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that other accounts associated with yours through Family Sharing, volume purchasing or Legacy Contacts may also access and use it.
  • Support is ours. We are solely responsible for providing maintenance and support for DagWorld, as set out in these terms or as required by law. Apple has no obligation whatsoever to furnish any maintenance or support services for it.
  • Warranty, and the one thing Apple does. We are solely responsible for any product warranties, whether express or implied by law, so far as they are not effectively disclaimed in section 12. If DagWorld fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you. To the maximum extent permitted by law, that refund is the whole of Apple's warranty obligation, and any other claim, loss, liability, damage, cost or expense arising from that failure is ours alone to answer for.
  • Claims about the app come to us. We, not Apple, are responsible for addressing any claim you or a third party make relating to DagWorld or to your possession and use of it. That expressly includes product liability claims, any claim that DagWorld fails to meet a legal or regulatory requirement, and any claim under consumer protection, privacy or similar legislation.
  • Infringement claims come to us too. If anyone claims that DagWorld, or your possession and use of it, infringes their intellectual property, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
  • Where you are. You represent and warrant that you are not located in a region subject to a United States Government embargo, or designated by the United States Government as a "terrorist supporting" region, and that you are not listed on any United States Government list of prohibited or restricted parties.
  • Who to contact. Questions, complaints and claims about DagWorld go to Benlottejnr Apps, at the postal address, telephone number and email addresses in section 18.
  • Other people's terms. You must comply with any applicable third-party terms when you use DagWorld. Two apply in the ordinary course: video is played through YouTube, so YouTube's terms govern that playback, and streaming or downloading over a mobile connection is subject to your network operator's own agreement with you.
  • Apple can enforce this. Apple and Apple's subsidiaries are third-party beneficiaries of these terms, and on your acceptance of them Apple has the right, and is deemed to have accepted the right, to enforce them against you as a third-party beneficiary.

17. General

If any part of these terms is found to be unenforceable, the rest continues to apply. Not enforcing a term straight away does not mean we give up the right to enforce it later. You may not transfer your rights under these terms to anyone else. We may transfer ours if our business is reorganised or sold, and your rights will not be reduced by that.

These terms are the whole agreement between you and us about DagWorld, and replace anything said before. That does not displace the rights section 16 gives Apple, which stand as written.
